Welcome to Hotpuppy! By accessing or using our website (“Hotpuppy” or “the Site”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree with any part of these Terms, do not use the Site.


1. Definitions

1.1. Hotpuppy: Refers to the website and its services.

1.2. User: Any person who registers or uses the Site.

1.3. Seller: A User who lists items for sale.

1.4. Buyer: A User who purchases items from a Seller.

1.5. The Locker Room: The section of the Site where Users buy and sell used sportswear and related items.

1.6. Merchandising: The section of the Site where Hotpuppy-branded items are sold directly by Hotpuppy.


2. Eligibility

2.1. To use Hotpuppy, you must:

  • Be at least 18 years old;
  • Provide accurate and complete registration information;
  • Comply with these Terms and applicable laws.

2.2. Hotpuppy reserves the right to suspend or terminate accounts if eligibility requirements are not met.


3. User Accounts

3.1. Users must create an account to use certain features of the Site.

3.2. Users are responsible for maintaining the confidentiality of their login credentials.

3.3. Hotpuppy is not liable for unauthorized access to accounts due to User negligence.


4. Marketplace (The Locker Room)

4.1. Listings:

  • Sellers may list used sportswear and related items that comply with our content and quality standards.
  • Listings must be accurate and truthful.

4.2. Sales Transactions:

  • Buyers pay the product price, including applicable fees, to Hotpuppy.
  • Payments are held by Hotpuppy until the order is marked complete and the Buyer confirms receipt in good condition.
  • After order completion, the amount is credited to the Seller’s virtual wallet.

4.3. Virtual Wallet and Withdrawals:

  • Sellers can withdraw funds from their virtual wallet only when the balance exceeds a defined threshold set by Hotpuppy.
  • Withdrawal methods include PayPal or bank transfer, subject to a commission fee described in the Seller Dashboard.
  • Withdrawals below the threshold are not permitted.

4.4. Seller Dashboard:

  • The Seller Dashboard allows Sellers to manage products, orders, store settings, payment methods, and more.

4.5. Commission:

  • Hotpuppy charges a buyer protection fee on items sold in The Locker Room to protect buyers in case of disputes. This commission rate is displayed during the listing process.

5. Merchandising

5.1. Hotpuppy sells branded merchandise directly to Users.

5.2. Purchases in the Merchandising section are subject to the return and refund policy outlined in Section 8.


6. Prohibited Items and Activities

6.1. The following items are prohibited:

  • Counterfeit goods;
  • Items that violate intellectual property rights;
  • Illegal, hazardous, or stolen items.

6.2. Prohibited activities include:

  • Using the Site for fraudulent purposes;
  • Misrepresenting items;
  • Harassing or abusing other Users.

6.3. All product photos uploaded by Sellers must be legitimate and accurately represent the item being sold. Photos may not contain nudity, obscene material, or content that violates our standards.


7. Live Chat and Messaging

7.1. Buyers and Sellers can send private messages to each other through the Live Chat area.

7.2. Messages can be used to:

  • Request more information about an item;
  • Share additional pictures of an item.

7.3. Users are prohibited from sending messages for:

  • Advertisements;
  • Malware;
  • Unsolicited or mass messages sent to five or more Users;
  • Content that is illegal, obscene, harmful, unethical, threatening, or inappropriate.

8. Payments and Fees

8.1. Buyers pay Hotpuppy directly for products purchased.

8.2. Hotpuppy releases funds to Sellers only after Buyers confirm receipt of products in good condition.

8.3. Sellers may incur withdrawal fees, as specified in their Seller Dashboard.

8.4. Sellers are prohibited from selling items purchased in bulk or dropshipping products they do not physically possess.

8.5. Service fees are clearly communicated before transactions are completed.


9. Shipping

9.1. Prepaid Shipping:

  • Sellers can download a Prepaid Shipping Label on the Site after the Transaction.
  • After a Transaction is completed, detailed shipping instructions will be sent to the Seller by email.
  • Shipping Labels are provided by Hotpuppy, which transacts with carriers to transport and deliver the Item.
  • Hotpuppy uses a Locker-to-Locker or Drop-off-to-Pick-up delivery system. Orders are not delivered to the Buyer’s door.
  • The system will automatically select:
    • The nearest drop-off point or locker for the Seller to deposit the Item.
    • The nearest pick-up point or locker for the Buyer to collect the Item.
  • Sellers must use the provided label to send or return Items within five business days of purchase.
  • Sellers must follow the shipping instructions provided by email and on the Site. Failure to comply may result in cancellation of the Transaction.

9.2. Shipping Costs:

  • Fees vary based on parcel size, route, carrier, and discounts.
  • Costs are displayed before checkout.
  • Sellers must define the correct Product Weight class.

9.3. Tracking:

  • Users can track shipments via carrier websites.
  • Hotpuppy disclaims liability for inaccurate tracking information provided by carriers.
  • Delivery times depend on the carrier used.

9.4. Compliance and Disputes:

  • Sellers must comply with carrier Packaging Rules and Hotpuppy’s Forbidden Item list.
  • Disputes about lost or damaged Items rely on carrier-provided information unless evidence is submitted otherwise.
  • If a parcel is lost or damaged during transit, Hotpuppy will attempt to secure compensation and refund affected Users.

9.5. Alternative Shipping Methods:

  • Sellers using non-prepaid shipping are responsible for losses or damages and must seek compensation directly from carriers.

10. Returns and Refunds

10.1. The Locker Room: Transactions are final unless the item received is significantly not as described.

10.2. Merchandising: Returns are accepted within 14 days of receipt for unworn, unused items in their original condition.


11. User Responsibilities

11.1. Users agree to:

  • Use the Site responsibly;
  • Respect other Users and their privacy;
  • Report suspicious or prohibited activity.

12. Liability

12.1. Hotpuppy is not liable for:

  • Items sold in The Locker Room;
  • Disputes between Buyers and Sellers;
  • Indirect or consequential damages.

12.2. Our liability for Merchandising items is limited to the purchase price of the item.


13. Termination

13.1. Hotpuppy reserves the right to suspend or terminate accounts for violations of these Terms.

13.2. Users may deactivate their accounts at any time.


14. Changes to Terms

14.1. Hotpuppy may update these Terms from time to time. Changes will be communicated through the Site.


15. Reporting Issues and Disputes

15.1. To report issues:

  • If you find out that another User has done something illegal, violated someone else’s rights, or breached these Terms, you can notify us by blocking the member and reporting by clicking on the displayed buttons in the product page and in Live Chat.
  • We’ll try to help the affected party and will cooperate with local authorities if required.

15.2. To raise a dispute with us:

  • If there’s a disagreement between you and us, please let us know by contacting us, so we can try to resolve the issue as quickly as we can.
